- Scope of Application
The following terms and conditions apply to the business relationship between Spike Studios eU, Löwengasse 18/2, 1030 Vienna (hereinafter referred to as “Spike”) and the customer, provided that the customer is a consumer within the meaning of §1 KSchG.
- Terms of Contract
You subscribe to the magazine at the applicable subscription price initially for the minimum subscription period, thereafter the subscription shall be renewed on an ongoing basis for a further year at a time.
The subscription fee is due in advance. In the event of price adjustments during the contract period, the subscription price valid from the time of the adjustment shall be paid; the new price shall apply from the next invoicing. Insofar as prices are not expressly designated as net prices, prices shall be understood as gross prices, which include the applicable statutory value added tax; in the event of a reduction of applicable value added tax rates, Spike shall not be obligated to adjust the gross price.
The minimum subscription period starts with the first month to be paid. If there are interruptions in delivery, the minimum subscription period shall be extended in accordance with the duration of the interruption in delivery. In case of late payment, Spike is entitled to interrupt or stop the delivery.
The reduced subscription price for students can only be granted upon presentation of a valid certificate of enrolment.
The timely processing of subscription, payment type, banking, delivery changes, etc. is only guaranteed if the notification is received by Spike at least 10 calendar days in advance. In case of relocation, Spike must be informed immediately of the subscriber’s new address.
- Revocation
You have the right to revoke this contract within fourteen days without giving any reason. To exercise your right of withdrawal, you must inform us by means of a clear statement (e-mail) of your decision to withdraw from this contract.
- Cancellation Provisions
The subscription can be cancelled at the earliest at the end of the minimum subscription period and at any time thereafter in writing (by email).
- Payment
Payment can be made by credit card, Paypal, and SEPA direct debit. If payment is made by SEPA direct debit, you hereby revocably authorize Spike or a company affiliated with Spike to collect the payments to be made by you from your account by recurring SEPA direct debit when due. Your account-holding bank is also hereby authorized to honour the direct debits. The latter is also authorized to return direct debits, in particular if the account does not have the required cover. You have the right to initiate a chargeback to your account within 56 calendar days (8 weeks) of the debit date without giving any reason. Since you are appropriately informed about the amount and debit dates, you revocably waive the right to a corresponding pre-notification prior to the execution of the direct debits. Please ensure that your account is covered accordingly.
6. Delivery
6.1 Delivery shall be made to the delivery address specified by the customer.
6.2 Delivery defects must be reported immediately. Spike shall only be liable for non-deliveries, delayed deliveries or property damage in the course of delivery in case of intent or gross negligence. No liability shall be assumed for Spike copies arriving late or missing abroad.
6.3 Delivery of the first issue will take place a maximum of 12 weeks after receipt of the order, unless a different delivery start date has been agreed upon. You can choose the delivery start date in the order process.
7. Warranty
In the event of defects in the delivered goods, the statutory warranty rights shall apply.
8. Applicable law / Place of Jurisdiction
The concluded contract is exclusively subject to Austrian law. Exclusive place of jurisdiction is Vienna.
